"Nonazbittage Certificate" means the Tax and Nonazbitrage Certificate provided by the City on the date of the execution and delivery of the Bonds. "Outstanding" when used with reference to the Bonds, and as of any particular date, means all Bonds theretofore delivered except: (a) any Band cancelled by the Trustee a[ or before said date and (b) any Bond in lieu of or in substitution for which another Bond shall have been delivered pursuant to the Trust Agreement. "Owner" or "Bond Owner" or "Owner of Bonds" or any similar term, when used with respect to the Bonds, means any person who shall be the registered owner of any Outstanding Bond "Payment Fund" means the fund by that name established under, and hel d by the Trustee pursuant to Section 206 of the Tmst Agreement. "Payment Dates" means May 1 and November I of each year, commencing November I, 1994. "Permitted Encumbrances" means, with respect to the Project, as of any particulaz time: (i) liens for general ad valorem taxes and assessments, if any, not then delinquent, or which the City may, pursuant to provisions of Article V of the Lease Agreement, permit to remain unpaid; (ii) the Trust Agreement; and (iii) the Lease Agreement; and (iv) such other encumbrances as aze approved by the Authority. "Permitted Tnvestments" means any of the following which at the time of investment are legal investments under the laws of the State of California for the moneys proposed to be invested therein: (i) Federal Securities; (ii) bonds, debentures or notes or other evidence of indebtedness payable in cash issued by any one or a combination of any of the following federal agencies: Export Import Bank of the United States, Federal Financing Bank, Federal Farm Credit Bank, Farmer's Home Administration, Public Housing Authority, the Government National Mortgage Association, Federal National Mortgage or Federal Home Loan Mortgage Corp.; provided that the amount of such investment shall not exceed 10% of the aggregate amount of Bonds Outstanding; (iii) Certificates of deposits, time deposits, savings accounts of any bank (including the Trustee) or savings and loan association which a,-e (a) fully insured by the FDIC or (b) properly secured at 100% at all times by collateral described in clauses (i) and (ii) above; (iv) investment agreements or other evidence of indebtedness payable in cash issued by any bank or bank holding company or any other Authority the unsecured debt H406901 M.Ial
