If the Property. Owner transfers the property for the right-of-way and/or <br />grant easements, the City shall, at the request of Property owner, take such <br />steps as may be necessary to return said property anck'or easements to <br />Property O~mer in the event that (i) neither PG&E nor the City move <br />forward with construction of the improvements or (ii) all necessary grants <br />of Vineyard Avenue right-of-way are not obtained by the City. <br /> <br />IV. <br /> <br /> Construction of Improvements. <br /> <br />A. In the event PG&E facilities precede construction of the roadway <br /> improvements, City shall ensure that the full roadway rough grading shall <br /> be completed in conjunction with the PG&E project. <br /> <br />B. The City shall fund construction of the roadway improvements and <br /> associated utilities shown in Exhibit D (the "Phase I Improvements). The <br /> City shall make good faith eflbrts to ensure the timely construction of <br /> these improvements insofar as it is within its power to do so. The intent of <br /> the parties is to have these improvements completed by September 1. <br /> 2003. <br /> <br />C. Phase II and Phase III improvements will be constructed in accordance <br /> with the Specific Plan and conditions of approval.
