After the meeting had been called to order again,
Councilman Rivolta of the finance committee reported that the committee had examined and
approved the claims and he made a motion to the effect that they be paid. His motion was
seconded by Councilman Madsen and with all the councilmen present in favor of same. Councilman
Rivolta reported that the officers monthly reports.were accepted and he moved that they be
placed on file. There were no objections to same.
The Mayor called upon Attorney Nilson with regards to the Milk Inspection matter.
Attorney Nilson reported that Mr. Ramos and his partner of the Sanitary Dairy had a Writ
of Mandamus issued and they were endeavoring to show cause why the permit had been revoked,
and that they were no longer able to make deliveries in Pleasanton. Mr. Nilson.stated that
the matter had been set for a hearing in the Superior Court in Oakland last Friday, March
3d before Judge Harris, but that Judge Harris had disqualified himself on account of being
a property owner of Pleasanton and that the matter would be assigned to another court and
would be heard March 8th at 10 o'clock. Mr. Nilson went on to state that the matter to be
settled involved the 25.mile radius and it might be necessary to eventually amend the ordinance.
He also stated that some situations might enter into-the matter which would.have to be determined
upon. A .short discussion on the situation among the councilmen followed.
Councilman Madsen of trie Public Utilties committee brought up the matter of the water
bill of Manuel E. Rose Jr. of Angela Street, and an excess charge of $1.05 which appeared on
the O'ctob.er 1938 bill and which Mrs. Rose refused to pay. The Clerk was called upon to
present the meter readings and after a discussion among the councilmen, it was ordered that
Councilman Madsen should speak to Mrs. Rose and.have her understand that the excess would
have to be paid.
Councilman Trimingham of the Street and Building Committee took up the matter of a
request from Joe Vizzolini, who had recently purchased the old`Turner property on Rose
Avenue.- Mr. Vizzolini was anxious to remove the locust tree from in front of the - property
which presently would interfer with the display of a new sign that he was planning to
erect on his building. Mr. Triminghamtstated ±that Mr. Vizzolini was willing to plant a
black acae:.a tree in the vicinity of the locust tree and same-would conform to the planting
along -Rose Avenue. Councilman Madsen.felt that if it would improve the Vizzolini property
to remove the tree that same should be taken care of and mentioned that the new tree to be
planted °would conform to the general scheme and would be an improvement. The Council had no
objection to the tree being removed. Councilman Trimingham went.on to state that contrary
to general opinion the trees in front of the Geyser property were not in sound condition and
after they had been removed he took part of one of the trees to a member of the Improvement
Club committee who had objected and was able to convince her that the tree should be removed.
Councilman Trimingham advised that the surfacing of the streets had been completed and in
particular on'Third Street where considerable work had been done. He _ advised that the covering
put on Third Street was replaced by that which had been taken off.some time ago when the grade
had-bb en looked into. He also advised with reference to tree-.planting to be undertaken with-
in the city, of a meeting of the council members, the survey that had been made and the uniform
scheme of planting'which had been discussed. He further stated that the tree planting work
would get underway very soon as the trees had been ordered.
Councilman Brenner of the Laws and Judiciary committee reported that the stop signs
on First Street would be installed within a.week.
Councilman Rivolta of the Finance Committee was pleased to report that the treasury-,was
in good shape and all town funds in healthy condition. Councilman Rivolta took up the matter
of travelling expenses being allowed the Councilmen and such officers of the municipality
which might have to attend meetings etc. and be put to some personal expense in that regard.,
He solicited an expression from the City Attorney. Mr. Nilson advised that same could be
allowed• providing the usual claim was submitted showing the expenses involved, the occasion etc.
At Mayor Orloff fIs request, Councilman Brenner reported on a meeting of the East Bay
League of California Municipalities in San Leandro which they had attended. Councilman
Brenner spoke with reference to the many bills before the State Legislature-now affecting
California Municipalities and the need for representation at Sacramento to fight those which
would impair municipal progress etc. He further stated that he was convinced that the money
being spent by the Town of Pleasanton to the League.as dues was well worth what it cost.
