i 46.
Attorney Nilson then discussed with the Council the street matter as affecting Rose
Avenue. He reported that the Cou ty Surveyor had prepared a description of-the twelve foot
strip on the southwesterly side o; Rose Avenue and reported that a Resolution of Intention
to close the street would be necessary and also that certain notices would have to be posted
along the line of proposed work and also four insertions in The Pleasanton Times of the notice
would have to be published.-There was a short discussion on same among the councilmen, after
which Resolution No. 1735 - "Resolution of Intention to close up and abandon a portion of the
Southeastern part of Rose Avenue lying northwesterly of the intersection of said Rose Avenue
with Pleasanton Avenue in the Town of Pleasanton" was passed on motion of Councilman Brenner,
seconded-by Councilman Trimingham and with all present in favor of Same: Sam J. Whiting, pres-
ident of the Alameda County Agricultural Fair Association was present at the session and
discussed with the council the beautification project which was being contemplated along Rose
Avenue and which probably would be developed as a WPA project within the next 60 days. He also
discussed with the Council a project of putting in a swimming pool in the center field at the
race track and asked that the municipality give encouragement to such a project: Mayor Rivolta
responded for the Council to the effect that the municipality was 'interested in the beautification
project and hoped that it would progress soon after the strip had been conveyed to the County.
He also discussed the swimming pool and stated that the Council would await development of same.
Councilman Triminghem reported to the council that he noted that the digging in of the
Richards Gravel, pit was affecting the slopewall and he asked Mr. Rodrigues for a report. Mr.
Rodrigues stated that Mr: Richards was taking gravel away from the base of the wall and that
very soon something would happen to the wall that would cause-the town some financial annoyance.
There was a discussion among the Council and it was ordered that the City Council should meet
with the engineer the next afternoon at about 5 o'clock and investigate conditions and also the
Clerk was instructed to get in touch with Mr. Richards and have him present at the next Council
meeting. Councilman Trimingham asked Mr. Rodrigues to report with regards to the tree matter
in front of the Sohn C. Mendonca property. Mr. Rodrigues submitted photographs of what had
taken place as regards the tree roots and described the condition. The Mayor asked Attorney
Nilson for advice in the matter and Mr. Nilson stated that if Mr. Mendonca had violated any
ordinance with regards to tree removal etc. that he should be asked to appear before the
Council at its next regular meeting and state his case. The Clerk was directed to advise Ivir.
Mendonca to appear at the next regular meeting.
r
Councilman Trimingham reported on trees on St. Mary's Street about which some question
had been raised at the last meeting following the request of Mr. Guilianelli to remove same.
Mr. Trimingham reported that one of the trees appeared healthy, but there was a question as
to whether or not should something happen in a future wind storm what the liability of the
town would be and that he felt that pennission should be given. Councilman Brenner reported
that with Councilman Hansen he had looked over the tree situation and that one of the trees
looked bad and he suggested that it be removed. Following a. discussion among the Councilmen
it was ordered that Mr. Guilianelli should be given permission to remove the trees and that
he should plant other trees as he had agreed.
There being no further business the
regular session, Monda_ e ening, January
Approved:
t
r
meeting adjourned t
6th at -30 o'ct©
:30 o'clock to meet in
LO
Pleasanton, California, January 6, 1941.
The, Town Council of the Town of Pleasanton was called to order on the above written date
by Mayor Ambrose Rivolta.
