April 2003
California Regional Water Quality Control Board,
San Francisco Bay Region
1515 Clay Street, Suite 1400
Oakland, CA 94612
Re: Clean Water Revival Project
Dear Regional Board:
On March 21, 2000, your Executive Officer, Lawrence P. Kolb, approved a technical
report that was required as a pre- condition to the implementation of Dublin San Ramon Services
District's "DSRSD Clean Water Revival Project "Project The Project would have created
a small -scale recycled wastewater project pursuant to Order 95 -159, producing tertiary- treated
wastewater for injection into the Livermore Amador Valley groundwater basin. The City of
Pleasanton and Alameda Flood Control and Water Conservation District, Zone 7 "Zone 7
objected to injection of the highly treated water into the groundwater basin because of the basin's
role as a potable water supply for the region, and filed petitions for writs of mandate to overturn
the Executive Officer's decision. On April 29 and May 21, 2002 the San Francisco Superior
Court granted the petitions for writs of mandate, requiring the Board to set aside the Executive
Officer's decision to issue approvals for the project and hold a hearing to consider the additional
factors identified in the court's order and statement of decision, filed May 22, 2002.
DSRSD requests that the Regional Board take no further action on the Project at this
time, including holding any further hearings. DSRSD initiated the project primarily to provide
needed wastewater disposal capacity, which will be available through the expanded LAVWMA
facilities. As DSRSD no longer requires the project for wastewater disposal, DSRSD, as part of
a settlement with the City of Pleasanton and Zone 7, has agreed to not to pursue any water
recycling project that would involve direct injection of recycled water into any potable
groundwater basin through recharge or injection wells or other specific facilities without first
obtaining the approval of the legislative bodies of the City of Pleasanton and each of the agencies
permitted to pursue recycling projects pursuant to Order 93 -159. DSRSD is, therefore,
withdrawing its Project from any further Board review at this time.
Very truly yours,
Dublin San Ramon Services District
EXHIBIT A
