on a cooperative basis. <br /> AGREED TERMS <br /> In view of the foregoing, the Parties agree as follows: <br /> 1. Withdrawal of Application to Regional Board for Revival Project. <br /> DSRSD shall withdraw its application for approval of the components of the Revival Project <br /> that were approved by the acting Executive Officer of the Regional Board on March 21, 2000; <br /> specifically, within 10 days of the execution of this stipulation, DSRSD shall deliver to Pleasanton <br /> and Zone 7 care of the Pleasanton City Attorney, for ultimate submission to the Regional Board as <br /> provided in paragraph 2 below, a letter in substantially the form set forth in Exhibit A (attached). <br /> 2. Dismissal of Appeals and of the Underlying Actions. <br /> Pleasanton and Zone 7 shall submit to the Court, applications including this Agreement and <br /> Proposed Orders dismissing without prejudice case numbers 325166 and 500211, within 10 days <br /> after DSRSD has submitted its letter as provided in paragraph 1 of this Agreement. The applications <br /> and Proposed Orders shall be in substantially the same form set forth in Exhibit B (attached). Within <br /> 10 days after the entry of the Proposed Orders, the Pleasanton City Attomey shall deliver DSRSD's <br /> withdrawal of application to the Regional Board, unless DSRSD has notified Pleasanton that it has <br /> already delivered its withdrawal of application to the Regional Board (in substantially the form set <br /> forth in Exhibit A). Within 10 days after the entry of the Proposed Orders, DSRSD and Livermore <br /> shall dismiss their pending appeals of the orders in case numbers 325166 and 500211. <br /> 3.
