DES:df` 9/25/92R(001/54)
10/07/92R
In addition to the foregoing general requirements, the
pretreatment programs of City and District shall:
(1) Provide for enactment and enforcement of sewer use
ordinances or other rules or regulations which provide
authority for District to administer and enforce
pretreatment program requirements including: (i)
issuance of permits by District to industrial or
commercial or other non residential users of District's
or City's Collection Systems and the Regional Sewerage
Facilities and (ii) establishment of user charges,
including mandated recovery of federal grant funds from
industrial users. City's ordinance shall conform
substantially to District's ordinance, both of which
shall conform to the requirements of the RWQCB or such
federal and or other state agencies exercising
jurisdiction over such matters. Nothing herein
contained or contained in any subsequently adopted
ordinance covering the use of City's or District's
Collection Systems or the Regional Sewerage Facilities
shall prevent or constrain District from continuing its
permitting procedures relating to industrial or
commercial users existing upon the date hereof, or as
said procedures may, from time to time, be changed,
modified or superseded by District, toward the end that
no discharge shall be permitted from the users of
either City's or District's Collection Systems which
would prohibit District from complying with its NPDES
20
