Said connection fee shall be
uniform throughout the combined sewerage service areas of City
and District and shall be based upon the planned demand for
Treatment Capacity and Disposal Capacity of the parties within
their respective sewerage service areas. The parties shall
review such planned demand and the amount of said connection fee
during the annual reviews required pursuant to paragraph 16, or
more frequently as the parties deem necessary.
Funds derived from the basic uniform regional connection fee
or from the accumulations thereof, shall be used only for the
planning, design, acquisition and construction of improvements or
expansions to the Regional Sewerage Facilities or the facilities
of TWA or LAVWMA, or such other Joint Use Facility as to which
the parties may agree, or any portion, component, or element
thereof, which increases the Treatment Capacity Rights or
Disposal Capacity Rights of either of the parties.
In the event the Peak Flow emanating from the sewerage
service area of either party exceeds four times that party's
ADWF, said party shall, upon discovery or notice of such excess
flow, correct said condition within a reasonable time. If such
excess flow is not corrected within one year from the date of
discovery or notice thereof, the party to which such excess flow
is attributable shall pay additional basic uniform regional
connection fees (based on DUEs) equivalent to that amount
necessary to acquire Disposal or Treatment Capacity Rights
sufficient to provide a total ADWF for that party which is
equivalent to one fourth (1 /4th) of the aforesaid Peak Flow.
31
