*Until such time as the City of Livermore "Livermore participates in <br /> LAVWMA's Expansion Project increasing the disposal capacity in <br /> LAVWMA's facilities to 41.2 mgd PWWF, the above allocations without <br /> Livermore's participation shall govern. The provisions of this paragraph <br /> shall be self- executing, such that, if Livermore shall participate in <br /> LAVWMA's Expansion Project, the allocations hereinabove based upon <br /> Livermore's participation shall become effective without further <br /> amendment or action of the parties. <br /> The foregoing allocations of Treatment Capacity Rights shall <br /> be effective from and after the date that District's WTP Stage 4 <br /> Expansion Project increasing the Treatment Capacity thereof to <br /> 17.0 mgd ADWF becomes Operational. The foregoing allocations <br /> of Disposal Capacity Rights shall become effective from and after <br /> the date that LAVWMA's Expansion Project increasing its Disposal <br /> Capacity to 41.2 mgd PWWF becomes Operational; provided, that <br /> the allocation based upon Livermore's participation in the <br /> LAVWMA Expansion Project shall be effective upon that <br /> eventuality. <br /> (ii) Transfers of Treatment Capacity Rights. From and after <br /> the date upon which District's WTP Stage 4 Expansion Project <br /> becomes operational, paragraph 3 of the First Supplemental <br /> Agreement, entitled "Treatment Capacity Transfer," shall be <br /> replaced and superceded in its entirety by the provisions of this <br /> subparagraph (ii), except for subparagraph (b) of said paragraph 3, <br /> which shall remain in full force and effect until the expansion <br /> component of LAVWMA's Expansion Project becomes Operational. <br /> When District's WTP Stage 4 Expansion Project becomes <br /> Operational all transfers of Treatment Capacity Rights between the <br /> -6- <br /> Agmt-28 <br /> F\sh\sh \DSRSD <br /> DES:rg:04/19/99;08/21 /OOR <br /> AK v. 2: 10 /10 /OOR; DES 10/22/00 <br />
