DES:df* 9/25/92R(001/54) <br /> 10/07/92R <br /> WHEREAS, in view of said increasing needs, and in <br /> furtherance the long- standing cooperative efforts of City and <br /> District to address the wastewater management concerns and <br /> requirements of their respective jurisdictions on a consolidated, <br /> regional basis, the parties desire to enter into this <br /> comprehensive agreement superceding all prior agreements; <br /> NOW, THEREFORE, in consideration of the above premises and <br /> of the mutual promises herein contained, the parties hereto agree <br /> as follows: <br /> 1. DEFINITIONS. The following words, terms and phrases <br /> wherever used in this agreement shall have the meanings <br /> hereinafter respectively ascribed thereto: <br /> (a) ADMMF (average daily maximum month flow) the <br /> "Actual Flow" defined and measured with reference <br /> to flows of Wastewater for the average day of the <br /> maximum month in that certain agreement entitled, <br /> "Livermore Amador Valley Water Management Agency <br /> Sewer Service Agreement" dated February 1, 1978, <br /> by and among LAVWMA, City, District, and the City <br /> of Livermore, California. <br /> (b) ADWF (average dry weather flow) the arithmetic <br /> mean of average daily Wastewater flows occurring <br /> during dry weather months, determined in <br /> accordance with definitions and standards <br /> promulgated by the RWQCB. <br /> (c) City the City of Pleasanton, a municipal <br /> corporation of the State of California. <br /> 2 <br />
