RECORDER '88 JUN 9 P11 3 48 SHORT FORM GROUND LEASE b This Short Form Ground Lease is made and entered into as of this 1st day of June, 1988 by and between the CITY OF PLEASANTON, California, a municipal corporation ( "Lessor ") and EDEN HOUSING, INC., a California nonprofit corporation ( "Lessee "). A. Lessor is the owner of all that certain real property (the "Property ") situated in the City of Pleasanton, County of Alameda, California, commonly known as 5200 Case Avenue, Pleasanton, and more particularly described in Exhibit A attached hereto. B. Lessor wishes to lease to Lessee and Lessee wishes to lease from Lessor the Property together with all rights, privileges and easements appurtenant to the Property. follows: I. Upon the covenants and conditions and for the consideration set forth in that certain unrecorded lease of even date herewith by and among Lessor and Lessee (hereinafter referred to as the "Lease "), Lessor does hereby lease, the Property to Lessee, and Lessee does hereby lease the Property from Lessor. By this reference the Lease is incorporated in this instrument and made a part hereof. 2. The term of the Lease shall commence on June 1, 1988 and shall terminate at Midnight on May 31, 2038, unless the term is sooner terminated under the provisions of the Lease. See specifically Section 23 of the Ground Lease giving Lessor the right to terminate the Ground Lease after the termination of the HDG term and the approval of any holder of a note secured by the Property. 3.
