The Agency has loaned to the Borrower certain monies as evidenced by that certain "California <br />Housing Finance Agency and Municipal Bond Investors Assurance Corporation Promissory Note, CHFA <br />Development No. 87- 007 -N" (hereafter the "Note "), dated January 1, 1990, in the original principal amount <br />of Nine Million Three Hundred Sixty Thousand and No /100 Dollars ($9,360,000.00), which is secured by that <br />certain "California Housing Finance Agency Permanent Deed of Trust With Assignment of Rents" (hereafter <br />the "Deed of Trust ") executed by the Borrower, as trustor, to Santa Clara Land Title Company, as trustee, and <br />in favor of the Agency and the Municipal Bond Investors Assurance Corporation ( "MBIA "), as beneficiaries, <br />dated January 1, 1990 and recorded on January 12, 1990 as Instrument No. 90009860, in the Official Records <br />of the Alameda County Recorder; and <br />SAON2T3A <br />
