24. Waiver by Agency. No waiver by the Agency of any breach <br />of or default under this Agreement shall be deemed to be a waiver <br />of any other or subsequent breach thereof or default hereunder. <br />25. No Conflict With Other Documents. The Borrower and the <br />City warrant that it has not, and will not, execute any other <br />agreement (other than an agreement approved by the Agency in <br />writing) with provisions contradictory to, or in conflict with, <br />the provisions hereof, and that, in any event, the requirements of <br />this Agreement are paramount and controlling as to the rights and <br />obligations herein set forth and supersede any other requirements <br />in conflict herewith. <br />28. Citv's Interest Bound. The City hereby subjects all of <br />its right, title and interest in the Development to the provisions <br />of this Agreement and agrees to comply with the provisions hereof <br />to the extent that it has or obtains possession or control of the <br />Development during the term hereof.
