R E C I T A L S A. The Borrower is or is to become the owner of the real property described in Exhibit A attached hereto and made a part hereof (the "Property "), and has applied to the Agency for loans (the "Loan ") to finance a multifamily rental housing development (the "Development ") pursuant to the provisions of the Act, particularly those provisions contained in Chapter 6.7 of the Act (the "Law "). The Development includes the Property, all improvements constructed on the Property and all funds or property, of whatsoever kind or nature, committed to the Development. B. The Loan is to be evidenced by a Promissory Note of the Borrower (the "Note ") secured by, among other things, a Deed of Trust, Assignment of Rents, Security Agreement and Fixture Filing of the Borrower (the "Deed of Trust ") covering the Development and such other documents as the Agency may require to evidence and secure the Loan, all of which, including this Agreement, shall be collectively referred to as the "Loan Documents ".
