III. Dedication of Right-of--Way and Easements. <br />A. Property Owner agrees to dedicate the following interests in real property <br />as shown in Exhibit B: <br />(1) Roadway right-of--way for the construction of the realigned <br />Vineyazd Avenue and the southerly portion of the loop road azound <br />the school site; <br />(2) Temporary construction easements azound the above-described <br />lands as shown on the Vineyazd Avenue Realignment-Right-of- <br />Way/Easement Exhibit, dated May 7, 2002 and incorporated herein <br />by this reference, in the form attached as Exhibit C, to last until the <br />improvements have been accepted by the City. <br />B: All rights-of--way and easements shall be granted within 15 days of <br />Property Owner's receipt of request for same by the City's Director of <br />Public Works, who is hereby empowered to accept and record such grants. <br />C. The Director of Public Works shall request the dedications only in the <br />event: <br />(1) PG&E gives notice to the City that it intends to build its 230KV <br />transmission line in the realigned Vineyard Avenue and is moving <br />forwazd with construction; and <br />(2) the City has given its final authorization to constructing the <br />realigned Vineyazd Avenue and associated improvements. <br />Revision #2, Draft Lin Development Agreement Page 7 of 17 <br />
