D. If the Property Owner transfers the property for the right-of--way and/or <br />grant easements, the City shall, at the request of Property owner, take such <br />steps as may be necessary to return said property and/or easements to <br />Property Owner in the event that (i) neither PG&E nor the City move <br />forward with construction of the improvements or (ii) all necessary grants <br />of Vineyazd Avenue right-of--way aze not obtained by the City. <br />IV. Construction of Improvements. <br />A. In the event PG&E facilities precede construction of the roadway <br />improvements, City shall ensure that the full roadway rough grading shall <br />be completed in conjunction with the PG&E project. <br />B. The City shall fund construction of the roadway improvements and <br />associated utilities shown in Exhibit D (the "Phase I Improvements). The <br />City shall make good faith efforts to ensure the timely construction of <br />these improvements insofaz as it is within its power to do so. The intent of <br />the parties is to have these improvements completed by September 1, <br />2003. <br />C. Phase II and Phase III improvements will be constructed in accordance <br />with the Specific Plan and conditions of approval.
