infrastructure to those properties? He also wanted to know who would be paying for the elections
and would mail ballot elections be allowed. He also wanted to know if the public would have the
opportunity to learn the position of each City Councilmember regarding the Initiative.
Mr. Swift indicated as to Happy Valley, the Initiative changes the land use designation, not
to agricultural and grazing, but to a new category. Nor does the initiative change the Happy Valley
Specific Plan because it would still be consistent with the General Plan under the Initiative. The
Vineyard Corridor is the only area in the City that would be changed to agricultural/grazing. In
order for Vineyard Corridor to detach the property owners would need the approval of the City. It
would be difficult to detach because of the connection to Ruby Hill.
Mr. Roush was not aware of any case authority prohibiting the City from imposing the cost
of an election on a developer. He understood that an election would be another cost of the
development, much like a processing fee. In terms of a mail ballot election, there has to be less
than 1000 voters; the City has approximately 35,000 registered voters. He also indicated the cost
would be significantly less if an election took place during a regular election and not held as a
special election.
Mr. Swift said staff did not evaluate whether the five areas would be viable as agricultural
uses. He indicated that most agricultural properties have ceased producing high volume water
agricultural uses because the Tri-Valley no longer has an economic core of agricultural workers,
equipment or other support items. He said there are viable economic uses. The Vineyard Corridor
has soils that would support agricultural uses. In respect to the other areas, it is unknown at this
time whether they could support agricultural uses. The City does provide water to all properties
within the City limits as long as the proposed user pays for the infrastructure to carry the water to
the property. The City would be obligated to provide treated water if one of the properties in
Vineyard Corridor sought to use City water for agricultural use. Agricultural water is currently
being provided by Zone 7 to the existing viticulture areas at a much lower cost on a temporary
basis, but Zone 7 probably does not have enough untreated water to provide such water to all the
agricultural uses.
Mayor Tarver said four of the five Councilmembers have signed ballot measures, which
indicates where they stand.
Pam Chrisman, 1944 Vineyard Avenue, reiterated the annexation process for Vineyard
Corridor. She is okay with the reduction in density since she annexed to the City. She would like a
new road built and urged Council to accept Lone Star's offer to construct a new road.
Sharen Heinz, 1550 Vineyard Avenue, said the Vineyard Corridor people gave up their
rights to capture Ruby Hill. She said a new road should have been built a long time ago. She asked
the City to release Vineyard Corridor from the City. She said nothing has ever been accomplished
in nine years. She does not want to lose her property rights.
Pleasanton City Council 14 08/23/99
Minutes
