Mr. Erickson said the purpose of the agriculture designation is to give the voters a chance to
review the decisions made by the Council. If the Specific Plan were put on the ballot it would
eliminate the need for further voting on the Vineyard Avenue.
Ms. Michelotti said the deadline has passed in order to put the Specific Plan on the
November ballot. Therefore if CAPP passes, the property is designated agriculture. A
development agreement should be created to save what has already been approved. She did not
understand why annexed property was included in the Initiative.
Mr. Erickson said the live largest undeveloped areas that would have the most impact to the
community were included in the Initiative.
Ms. Dennis said there are some areas of the Initiative that are not clear. She said it is
unclear if voter approval is to be a ratification of the Council or Planning Commission process or
whether a project could go directly to the voters.
Mr. Erickson said the planning process would be appended by a vote of the people. A
developer could choose to bypass the planning process and go directly to the vote of the people, but
only after collecting the necessary number of signatures.
Ms. Dennis understood projects that have development agreements already would not be
affected by the Initiative.
Mr. Erickson said the Initiative process couldn't affect anything that has a vested right. He
said the Initiative has no effect over someone with a vested right to build a 100 story building in
Pleasanton.
Ms. Michelotti did not understand why properties that were already prezoned and had
PUD's had to go to the vote of the people.
Mr. Erickson said the concept of the Initiative is not to have two votes on any particular
project, but if a project is denied and resubmitted,it could have more than one vote.
Mayor Tarver understood it might be possible to use a planning process that would include
a variety of approvals and have only one vote.
Mr. Erickson said the concept is not to have multiple elections, but to allow voters to
approve things that are in reasonably blocked out fashion.
Ms. Dennis asked why Happy Valley was left out of the initiative.
Mr. Erickson said when he was working on the Initiative, information was not available
indicating that different projects might be tied together. The proponents of the Initiative looked at
Happy Valley separate from the Greenbriar and New Cities developments.
Pleasanton City Council 16 08/23/99
Minutes
