Mr. Roush said most of the property listed in the initiative is not within the City's land use
jurisdiction. With respect to the properties within the City, there are a number of uses that could be
implemented and therefore a "taking"issue should not be a concern.
Charles Lemoine, 4456 Foothill Road, said he made a decision approximately four years
ago to develop a portion of his property. His project is ready to go before the Planning
Commission and asked that this process not be put on hold because of the CAPP Initiative. He
would appreciate it if the process could be kept going. IIe said walnut growing in the Pleasanton
area is not very viable. He explained his property was used to produce walnuts, but the last year the
orchard was worked,he only received$175 for his efforts.
Norma Lemoine, 4456 Foothill Road, asked for the process to continue to submit their
project to the Planning Commission. She had a concern with how the public would be informed in
regards to development. Flow will the voters know whether it is a good project or not? What
qualifies the voters to make the decision? Only elected officials should be making these decisions.
If the people do not like a decision then let them run for office or referendum the decisions. She did
not want the voters making decisions on something they are not qualified for.
Mr. Roush said under the initiative a project is approved by the City Council and then it
goes to the vote of people. The proponents of the development presumably would campaign for the
project.
Ms. Michelotti thought the City should have some responsibility in getting information out
to the people.
Mr. Roush said under CAPP the City has no obligation to inform the public of a
development on private property.
Sean Lemoine,4456 Foothill Road, said if CAPP goes through and he wanted to develop a
nine-unit parcel and later develop four more units within five years on the same property that would
trigger an election. He felt people would not have all the facts in order to make a good decision.
The Initiative hurts the small developer. He believed the City should set aside extended family
funds in order to provide affordable housing. He felt the people who wrote the Initiative did not
realize how it would impact the small developers. He found it very discouraging and frustrating
that his efforts to build a home for his family might be squashed by the CAPP Initiative.
Mr. Swift said the Initiative provides that if additional development occurs within a three or
four year time frame, the second development could trigger a vote.
Cindy McGovern,9206 Longview Drive, said as a School Board member she has attempted
to discuss some of the issues with the Superintendent that were listed in the letter regarding the
impact of CAPP on the School District. She indicated that she like to have a public discussion
regarding the issues and hoped more forums could be held to educate the public. She asked how
the road and sewer infrastructure would be funded in order for a school to be constructed in the
Pleasanton City Counci I 19 08/23/99
Minutes
