6.11 Personal Obligations; Release. The obligations of an Owner pursuant to the <br />provisions of this Declaration are the personal obligations of an Owner, and an Owner shall not <br />be released from such obligations except as provided in the following paragraph. <br />if an Owner shall sell, transfer or assign its entire Lot or its interest therein, it shall, <br />except as provided otherwise in this Declaration, be released from its unaccrued obligations <br />under this Declaration from and after the date of such sale, transfer or assignment; provided, it <br />shall be a condition precedent to the release that the transferee shall acknowledge in writing <br />addressed to the other Owners of its obligations under this Declaration, and agrees to be bound <br />by this Declaration and perform all obligations under this Declaration in accordance with the <br />provisions of this Declaration. Failure to deliver any such written statement shall not affect the <br />running of any covenants, conditions, and provisions in this Declaration with the land, nor shall <br />such failure negate, modify or otherwise affect the liability of any transferee pursuant to the <br />provisions of this Declaration. <br />6.12 Time of Essence. Time is of the essence with respect to the performance of the <br />obligations contained in this Declaration. <br />6.13 Entire Declaration. This Declaration (including the Recitals which are part of <br />the substantive provisions of this Declaration) and the Exhibits contain the entire agreement <br />between the Owners with respect to the subject matter of this Declaration. The provisions of this <br />Declaration shall be construed as a whole according to their common meaning and not strictly <br />for or against any Owner. <br />6.14 Duration. This Declaration and each covenant, condition, and provision of this <br />Declaration will remain in effect for a term of ninety -nine (99) years from the Effective Date and <br />will automatically be renewed for successive ten (10) year periods unless all of the Owners who <br />are subject to this Declaration elect by written notice to so renew. <br />(Signature Page to Follow) <br />A -1 -9 <br />000299.0044110933 37.6 <br />
