3. Equipment and Antenna.
The Authority is responsible for conducting its own engineering and analysis of the
equipment and antenna necessary to operate the System from the Licensed Areas,
including a review of the Tower to ensure that the equipment and antenna are
engineered and designed to meet the Tower's specifications without compromising the
integrity of the Tower or its use by City or other occupants of the Tower or Property,
whose occupancy precedes Authority's use.
The License allows and requires the Authority to install, operate, and maintain
equipment on the Property for the operation of the System. The Authority shall not
replace, modify, or otherwise change the equipment identified in this Agreement without
the prior written consent of the City. The "Equipment" contemplated by this Agreement
is as follows:
A. Console Equipment: The Authority shall install five MCC 7500 radio consoles
with associated equipment identified in Attachment "B" ("Console Equipment) in the
Console Area.
B. Stack Equipment: The Authority shall install the supporting equipment identified
in Attachment "C" ("Stack Equipment") in the Stack Area.
C. Peripheral Connection Equipment: The Authority shall install the least intrusive
wiring, conduit, and other items as are reasonably necessary to connect the Console
Equipment to the Stack Equipment for their operation.
The Authority's use of the Licensed Areas and the Equipment shall not interfere with the
operation of any existing or future City equipment, antenna, structures, facilities on the
Property or Tower, or both. Likewise, the Authority's use of the Licensed Areas and the
Equipment shall not interfere with the operation of any antennas or uses occupying the
Tower or Property prior to the Authority's use.
If interference from the Authority's Equipment or Antenna is reasonably suspected in
violation of this section, then the City may direct the Authority to contract with a mutually
acceptable technical consultant to provide an independent determination regarding
interference issues. The Authority shall be solely responsible for the cost and expense
to obtain the determination. If the technical consultant finds after thorough conclusive
diagnostics that the Authority's Equipment is interfering with either the City's or a prior
occupant's equipment or antenna on the Tower or Property, the Authority at its own cost
and expense shall implement a solution in coordination with the City.
4. Access. The Authority may enter the Property to access the Licensed Areas for
the limited purpose of installing, maintaining, servicing, replacing, and operating the
EBRCSA License Page 3 of 10
Pleasanton Police Department
