City and Developer acknowledge and agree that Kiewit Infrastructure Co. <br /> ("Kiewit"),the current owner of the Kie-Con Property, is hereby made a party to the <br /> Reimbursement Agreement such that it shall be a required party to any modifications, <br /> amendments or changes to the Reimbursement Agreement. In no event, however, shall <br /> Kiewit have any liability under the Reimbursement Agreement other than the payment <br /> of Reimbursement Fees to the City in the manner provided by the terms thereof. <br /> 4.
