Such unpaid share of Assess- <br /> ( ments shall be collectible from the Owner of such Lot and if <br /> not collectible from such Owner shall be deemed to be Common <br /> Expenses collectible from the Owners of all of the Lots, <br /> including the transferee pursuant to Mortgage foreclosure, <br /> his successors or assigns. <br /> 14.10 Priorities; Enforcement; Remedies. <br /> 14. 10.1 When a notice of Assessment has been <br /> recorded against a Lot, such Assessment shall consti- <br /> tute a lien on that Lot prior and superior to all other <br /> liens except (i) all taxes, bonds, assessments and <br /> other levies which, by law, would be superior thereto, <br /> and (ii ) the lien or charge of any first Mortgage of <br /> record (meaning any recorded Mortgage with first prior- <br /> ity over other Mortgages ) made in good faith and for <br /> value. <br /> 14. 10 .2 Such lien, when delinquent, may be <br /> enforced by foreclosure by the Association,- its attor- <br /> ney or other authorized person, after failure of the <br /> Owner to pay such Assessment in accordance with its <br /> terms, such foreclosure to be conducted in accordance <br /> with the provisions of Sections 2924-2924h of the <br /> Californ:._a Civil Code, applicable to the exercise of <br /> powers of sale in mortgages and deeds of trust, or in <br /> any other manner permitted by law. <br /> 14 . 10.3 The Association shall have the right <br /> to bid for the Lot at foreclosure sale, and to acquire <br /> -57- <br />
