Livermore/Signature Sewer Service Agreement <br /> WHEREAS the City of Livermore, a California municipal <br /> corporation ("City") , the County of Alameda ("County") , and Ruby <br /> Hill Development Joint Venture ("Developer") a California general <br /> partnership between Signature Properties, I, a California limited <br /> partnership and Nicklaus/Sierra Development Corporation of <br /> Northern California, a California Corporation, have entered into <br /> an agreement ("Settlement Agreement") in settlement of claims <br /> made by the City in a petition for writ of mandate, Alameda <br /> Superior Court Action No. 583426-1 ("the Lawsuit") ; and <br /> WHEREAS, this Sewer Service Agreement is apart of and <br /> has been incorporated by reference into the Settlement Agreement <br /> and is referenced in certain Preannexation Agreements adopted in <br /> connection with the Settlement Agreement and all terms in this <br /> Agreement shall have the same meaning as such terms in the <br /> Settlement Agreement; <br /> Now, therefore, the City and Developer agree as <br /> follows: <br /> A. The City and Developer intend that a demonstration <br /> reverse osmosis facility be constructed in order to service the <br /> needs of the Ruby Hill Project and the needs of the City.
