AGREEMENT FOR WASTEWATER and DISPOSAL SERVICES <br /> This agreement made and entered into this 13th day of <br /> September , 1993 , by and between the CITY OF <br /> PLEASANTON, a municipal corporation of the State of California <br /> ("Pleasanton") , and the CITY OF LIVERMORE, a municipal <br /> corporation of the State of California ("Livermore") ; <br /> W I T N E S E T H <br /> WHEREAS, Pleasanton does not treat or dispose of wastewater <br /> emanating from the City's sanitary sewerage service area; and <br /> WHEREAS, Pleasanton has determined that it is more feasible <br /> to contract with Livermore to treat and dispose of wastewater <br /> emanating from certain land (the "Ruby Hill Project Area") <br /> located in Pleasanton, described in Exhibit A; and <br /> WHEREAS, Livermore has agreed to treat and dispose of the <br /> wastewater generated in the Ruby Hill Project Area subject to the <br /> terms and conditions stated in this agreement; and <br /> WHEREAS, Livermore as a party in the litigation City of <br /> Livermore v. County of Alameda. et al. , Alameda County Superior <br /> Court Action No. 683426-1, has agreed to provide sewer service to <br /> the Ruby Hill Project Area upon the terms and conditions set <br /> forth in the Sewer Service Agreement, set forth in Exhibit B, <br /> 1 <br />
