15. Default.
If Lessee shall be in default of any provision under this Agreement (except for nonpayment of
rent) for a period of(i) fifteen (15) days following the date of notice from Lessor with respect to a
default which may be cured solely by the payment of money or(ii) thirty (30) days following the date of
notice from Lessor with respect to a default which cannot be cured solely by payment of money then, in
either event, Lessor may pursue any remedies available to it against Lessee under applicable law,
including, but not limited to, the right to terminate this Lease Agreement.
If the non-monetary default may not reasonably be cured within a thirty (30) day period, this
Lease Agreement may not be terminated if Lessee commences action to cure the default within such
thirty (30) day period and proceeds with due diligence fully to cure the default. If Lessee shall be in
default of the covenant to pay rent, Lessor may pursue any remedies available to it against Lessee under
applicable law after giving Lessee three (3) days' notice of such default.
16. Hazardous Substances.
a. Lessee agrees that it will not use, generate, store or dispose of any Hazardous Material on,
under, about or within the Leased Premises in violation of any law or regulation.
b. Lessor represents, warrants and agrees (i) that neither Lessor nor, to Lessor's knowledge, any
third party has used, generated, stored or disposed of, or permitted the use, generation,
storage or disposal of, any Hazardous Material on, under, about or within the Leased
Premises in violation of any law or regulation, and (ii) that Lessor will not, and will not
permit any third party to use, generate, store or dispose of any Hazardous Material on, under,
about or within the Leased Premises in violation of any law or regulation.
c. Lessee agrees to defend, indemnify and hold harmless Lessor, its governing Board of
Directors, other boards, commissions, committees, officers, employees and agents from and
against any and all losses, liabilities, claims and/or costs (including reasonable attorneys,
consultants, and experts fees and costs) arising from any breach of any representation,
warranty or agreement contained in this paragraph. The foregoing provisions shall not be
deemed a limitation upon the provisions of paragraph 11 (Indemnification) above. As used
in this paragraph, "Hazardous Material" shall mean petroleum or any petroleum product,
asbestos, any substance known by the State of California to cause cancer and/or reproductive
toxicity, and/or any substance, chemical or waste that is identified as hazardous, toxic or
dangerous in any applicable federal, state or local law or regulation. This paragraph shall
survive the termination of this Agreement.
17. Taxes and Liens.
Pursuant to the provisions of Revenue and Taxation Code 107.6, Lessor hereby notifies Lessee
that Lessee's possessory interest in and to the Leased Premises may be subject to personal or real
property taxes. Lessee shall pay any and all such taxes, subject to such rights, if any, as Lessee may
have to protest or otherwise object to such payment, all in accordance with applicable law.
