DUBLIN SAN RAMON SERVICES DISTRICT 2013

1. DSRSD shall cause the PG&E utility lines and related PG&E facilities installed, used, and maintained by PG&E in the PG&E Easement to be relocated without expense to the City if and when made necessary by any change of grade, alignment, or width of any roadways, parking lots or other improvements within Val Vista Community Park for a City or other public purpose. DSRSD may use regional replacement funds for such relocation as provided for in the Regional Agreement. 2. DSRSD shall cause the AT&T communication lines and related AT&T facilities installed, used, and maintained by AT&T in the AT&T Easement to be relocated without expense to the City if and when made necessary by any change of grade, alignment, or width of any roadways, parking lots or other improvements within Val Vista Community Park for a City or other public purpose. DSRSD may use regional replacement funds for such relocation as provided for in the Regional Agreement. 3. The parties acknowledge that DSRSD's obligation for relocation costs does not apply in a situation where a private third party is undertaking work within the PG&E or AT&T Easements for private commercial purposes. 4. City will provide DSRSD as much advance notice as reasonably possible about any proposed modifications to the Val Vista Community Park which may affect the PG&E or AT&T Easements. 5. This Agreement shall bind any successors in interest to the parties. It is the express intent of the parties that this Agreement not be recorded.
