ARTICLE 18. Design Review

<br />Sec. 18.100. purposes and Authorization.
<br />In order to preserve the natural beauty of the City's site, to prevent
<br />indiscriminate clearing of property and the destruction of trees
<br />and shrubs, to prevent excessive grading of hillsides and creation
<br />of drainage hazards; to ensure that structures are properly related
<br />to their sites and to surrounding sites and structures, to prevent
<br />the erection of structures or signs that would be inharmonious
<br />with their surroundings; and to ensure that open spaces, parking
<br />areas, pedestrian walks, and landscaping are arranged to accom-
<br />plish the objectives of this ordinance, plans for all new uses and
<br />structures, except single family dwellings and duplexes, and for all
<br />directly illuminated signs, and all signs with a surface area of 24
<br />square feet or more, shall be subject to review by the Board of
<br />Design Review. The ugly, the inharmonious, the monotonous, and
<br />the hazardous shall be barred, but originality in site planning, archi-
<br />tecture, landscaping, and graphic design shall not be suppressed.
<br />Review shall include exterior design, materials, textures, colors,
<br />and means of illumination, but shall not consider elements of the
<br />design that are not visible beyond the boundaries of the site.

<br />Sec. 18.181. Board of Design Review: Membership and
<br /> Meetings.
<br />The Board of Design Review shall be composed of at least three
<br />members of the Planning Commission appointed by the chairman
<br />of the Commission. If the Board does not include the full Com-
<br />mission, its members shall be appointed for one year terms and
<br />shall serve until their successors are appointed. If the Board does
<br />not include the full Commission, the Board shall elect a chairman
<br />to serve a one-year term. The Board shall hold two regular meet-
<br />ings each month, provided that a meeting need not be held if no
<br />drawings in conformity with the requirements of this article have
<br />been submitted for review.

<br />Sec. 18.102. Drawings to be Approved.
<br /> a. No zoning certificate for a new use or structure or for the
<br /> exterior alteration or enlargement of an existing structure or
<br /> use that is subject to design review as prescribed in this ordi-
<br /> nance shall be issued until the drawings required by Sec. 18.103,
<br /> (Drawings to be Submitted), have been approved by the Board
<br /> of Design Review, the City Planning Commission, or the City
<br /> Council.
<br /> b. No zoning certificate for a new sign or change of the design
<br /> ur enlargement of an existing sign that is subject to design
<br /> review as prescribed in this ordinance shall be issued until
<br /> the drawings required by Sec. 18.103, (Drawings to be Submit-
<br /> ted), have been approved by the Board of Design Review, the
<br /> City Planning Commission, or the City Council.
<br />
<br />Sec. 18.103. Application and Fees.
<br />
<br />18,103.1. Drawings to be Submitted.
<br /> The owner or his authorized agent shall submit the following
<br /> drawings to the Zoning Administrator at the time of or prior
<br /> to applying for a zoning certificate:
<br /> a. A site plan, drawn to scale, showing the proposed layout of
<br /> structures and other improvements including, where appropri-
<br /> ate, driveways, pedestrian walks, off-street parking and off-
<br /> street loading areas, landscaped areas, fences, and walls. The
<br /> site plan shall indicate the locations of entrances and exits and
<br /> the direction of traffic flow into and out of off-street parking
<br /> and off-street loading areas, the location of each parking space
<br /> and each loading berth, and areas for turning nd maneuvering
<br /> vehicles. The site plan shall indicate how utilities service and
<br /> drainage are to be provided.
<br /> b. A landscape plan, drawn to scale, showing the locations o!
<br /> existing trees proposed to be removed and proposed to be re-
<br /> rained o~ the site, the location and design of landscaped areas
<br /> and the varieties and sizes of plant materials to be planted
<br /> therein, and other landscape features.
<br /> c. Grading .plans when determined by the Zoning Administra-
<br /> for to be necessary to ensure compliance with Sec. 18.100,
<br /> (Purposes).
<br />
<br /> d. Architectural drawings or sketches, drawn to scale, inch
<br /> lng floor plans in sufficient detail to permit computation
<br /> yard requirements, and showing all elevations of the propos
<br /> structures as they will appear upon completion. All exteri
<br /> surfacing materials and colors shall be specified.
<br /> e. Scale drawings of all signs that are subject to design revi,
<br /> showing size, location, material, colors, and illumination, if al
<br /> f. The Board of Design Review or the Zoning Administrator
<br /> require additional information if necessary to determine who
<br /> er the purposes of this article are being carried out, or
<br /> authorize omission of any or all of the drawings required
<br /> this section if they are not necessary. The Zoning Admit
<br /> trator shall specify the number of copies of each drawing
<br /> be submitted.
<br />
<br />18.103.2. Fee.
<br /> The application shall be accompanied by a fee established
<br /> resolution of the City Council to cover the cost of design
<br /> view as prescribed in this article.
<br />
<br />Sec. 18.104. Refen~al to Board of Design Review.
<br />The Zoning Administrator shall check all drawings submitted
<br />design review. If he finds that the plans meet the requirements
<br />all other articles of this ordinance, he shall submit the drawi~
<br />to the Board of Design Review. If the Zoning Administrator
<br />termines that a zoning certificate could not be issued with
<br />the granting of a use permit, the granting of a variance, or
<br />enactment of an amendment to this ordinance, he shall inf¢
<br />the applicant and shall not submit the drawings to the Board.
<br />
<br />Sec, 18.105. Action of Board of Design Review.
<br />Within 21 days of the date the drawings were submitted, the Bo
<br />of Design Review shall approve, conditionally approve, or di.~
<br />prove the drawings, or shall request fbe applicant to revise th~
<br />Failure of the Board to act within 21 days shall be deemed app~
<br />al of the drawings unless the applicant shall consent to an extens
<br />of time.
<br />
<br />Sec. 18.106. Effective Date of Design Review Decision.
<br />Within five days following the date of a decision of the Bo
<br />of Design Review approving or conditionally approving drawfl
<br />the Secretary shall transmit written notice of the decision to
<br />City Ceuncil and to the applicant. The decision shall become
<br />fective on the day following the first meeting of the Council a:
<br />notice of the decision has been received unless the Council
<br />elect to review the decisions of the Board.
<br />
<br />Sec. 18.107. Appeal to City Ce~ncli.
<br />A decision of the Board of Design Review may be appealed
<br />City Council by the applicant as prescribed in Sec. 1.111, (Apl
<br />to Board of Adjustment, City Planning Commission, or City
<br />ciD.
<br />
<br />Sec. 18.108. Action by City Council.
<br />Not later than at its next regular meeting following the filing
<br />an appeal from a decision of the l~oard of Design Review by
<br />days, or following a meeting at which the City Council elect,~

<br />Design Review, the Council shall approve, conditionally approve
<br />disapprove the drawings, or shall request the applicant to re

<br />18.100, (Purposes) Failure of the Council to act within the time
<br />iud prescribed by this section shall be deemed approval of the
<br /> ings unless the applicant shall consent to an extension of time
<br />
<br /> Sec. 18.109. Lapse o/ Design Review ,~pproval,
<br /> Design approval shall lapse and shall be void one year
<br /> the date upon which the drawings were approved, unless prio:
<br /> the expiration of one year a building permit is issued and const
<br /> lion is commenced and diligently pursued toward completion.
