return of any item of the Equipment, (d) any accident in connection with the operation, <br /> use, condition, possession, storage or return of any item of the Equipment resulting in <br /> damage to property or injury to or death to any person, and/or (e) the breach of any <br /> covenant in a Lease or any material misrepresentation contained in a Lease. The <br /> indemnification arising under this paragraph shall continue in full force and effect <br /> notwithstanding the full payment of all obligations under all Leases or the termination of <br /> the Lease Term under all Leases for any reason. <br /> Section 13.03. Binding Effect. Each Lease shall inure to the benefit of and shall be <br /> binding upon Lessor and Lessee and their respective successors and assigns. <br /> Section 13.04. Severability. in the event any provision of any Lease shall be held <br /> invalid or unenforceable by any court of competent jurisdiction, such holding shall not <br /> invalidate or render unenforceable any other provision hereof. <br /> Section 13.05. Amendments, Changes and Modifications. This Agreement and each <br /> Lease may only be amended by Lessor and Lessee in writing. <br /> Section 13.06. Execution in Counterparts. This Agreement and each Lease may be <br /> simultaneously executed in several counterparts, each of which shall be an original and all <br /> of which shall constitute but one and the same instrument. <br /> Section 13.07. Applicable Law. This Agreement and each Lease shall be governed <br /> by and construed in accordance with the laws of the State. <br /> Section 13.08. Captions.
