ATTACHMENT 15
Maria Hoey
Subject: FW: Lund Ranch II Development --Adopt Planning Commission vote for Option 2
From: allison chang
Sent: Friday, August 28, 2015 1:48 PM
To: Mayor and City Council
Subject: Lund Ranch II Development-- Adopt Planning Commission vote for Option 2
Dear City Council Members,
We write in support of the Planning Commission's vote in favor Option 2 for the Lund Ranch II
development. All traffic coming from that development should properly be routed through the
Sycamore Creek neighborhood as has been in the General Plan for the past 25 years and has been
noted in the Sycamore Creek development plan and in their HOA's CC&R's.
We urge you to adopt the Planning Commission and planning commission staff recommendation of
Option 2 for several reasons which we will articulate below.
* The City has been a part of, ratified and recognized an agreement with the Ventana Hills and
Mission Hills neighborhoods for over 25 years providing that all traffic from a future Lund Ranch II
development would not be routed through our neighborhoods. This agreement was relied upon by all
subsequent home-buyers including us as an inducement for buying our properties. In fact, we were
specifically told by the city that Lund Ranch Road would always be a dead end when we were
considering buying our house. We believe that the City's acquiescence to that agreement and 25
years of indications that the City would follow it, should not be broken now. We understand that there
is an legal opinion that believes the city is not a part of that agreement. However, the legal doctrines
of ratification, detrimental reliance, and 3rd party beneficiaries would all make the City liable for
following that agreement. The aforementioned legal opinion did not consider those bases for
obligation by the City. Under those legal principles, the City is legally bound to follow the agreement
to route all Lund Ranch II traffic through the Sycamore Creek neighborhood.
* Routing any more traffic past Mission Hills Park is extremely dangerous. Mission Hills Park is the
lifeblood of this corner of Pleasanton. It is used from the early morning to the late evening by dog
walkers, seniors exercising, sports practices, families, parties, hikers, etc. My own two children (8
and 4 years old) had a daily ritual of going to the park until they went to pre-school. Even now with a
third grader, we ride bikes, take walks and play in the park at least twice a week. The park is in high
usage by the entire community of Ventana, Mission Hills and Sycamore Creek and even those from
the Bonde, Kottinger, and further out areas. The traffic studies that Greenbrier did only considered
vehicular traffic. It did not consider the high and considerable foot, bike, dog, senior and child
traffic. We have even seen red tail foxes in the park. Putting any more traffic around the park either
by humongous construction trucks, or the traffic from 50 more homes, or the traffic by creating a cut
through from Sycamore to Ventana Hills would endanger everyone who uses the park. I challenge
you to drive by the park at 4 pm -- you will see soccer teams, little kids in the jungle gym, seniors
taking walks, a plethora of dogs and older kids playing basketball and riding bikes. Or drive by the
park at 7 am and you will see seniors doing tai chi, dog walkers, joggers, and bike riders. Or drive by
the park at 7 pm and you will see families taking evening strolls. Or drive by in the middle of any day
1
