Based on the <br /> information submitted, the Director of Planning and Community Development has determined that the <br /> outdoor dining area would not be detrimental to the public health, safety, and general welfare. In <br /> addition, the Director of Planning and Community Development finds that the proposed modification is <br /> consistent with the previous use permit findings made for this application. Therefore,pursuant to <br /> Sections 13.04.435 and 18.124.120 of the Municipal Code and Condition of Approval No. 3 of City <br /> Council Resolution No. CC-05-008, the Director of Planning and Community Development hereby <br /> approves the outdoor dining permit and conditional use permit modification subject to the conditions of <br /> approval as shown on the attached "Exhibit B." <br /> This approval will become effective 15 days from the date of this letter unless appealed prior to that <br /> time.
