Mayor Long was absent.
Mr. Fales, City Manager, Mr. Struthers, City Attorney, Mr. Campbell, City Engineer,
Mrs. Lund, Deputy City Clerk, were present. Mrs. Woodward, City Clerk, was absent.
PLEDGE OF ALLEGIANCE TO THE FLAG was led by Vice Mayor Cairo.
MEETING OPEN FOR ANY MEMBER OF THE AUDIENCE TO ADDRESS THE COUNCIL. Mrs. Thibault
addressed the Council in the matter of a letter which she received from the City
Engineer. This letter stated that the public improvements in the Mission Park
Subdivision must be completed before the one year deadline subsequent to the com-
pletion of the Subdivision. The letter went on to say that if this were not done
the City would be required to take action against their surety.
Mrs. Thibault recalled some of the background between the City and the developer
and ultimately between the property owners regarding what she thought was the status
of these public improvements. She went on to say that she was under the impression
that the property owners were under no obligation to complete these improvements
and that this was a matter that should be discussed between the City and the deve-
loper.
Mr. Struthers outlined the legal aspects of the problem in which, depending upon the
agreement between the property owners and the developer, the property owner might
be liable for these improvements.
The Council advised Mrs. Thibault that she should investigate the relationship be-
tween the developer and property owners further, and that the staff will prepare a
full report on this matter for the next regular meeting of the City Council.
Mrs. Thibault also stated that the odor from the sewage treatment plant was stronger
in these last few weeks and requested that the City remedy the situation. The City
Engineer explained that the Cheese Factory was currently installing a pump which
would physically prohibit the accidental dumping of cheese whey into the system
which in turn causes the odor. The Council instructed the staff to examine the
situation closely in the next few days and prepare a complete report for the
Councils review at the net regular meeting.
PUBLIC HEARINGS were not scheduled for this meeting.
REPORTS OF BOARDS AND COMMISSIONS were not scheduled for this meeting.
Application of the Planning Commission for an Amendment to the Pleasanton General
Plan ssiAssi a "H i g h Density" Land Use Desi nation to the Area Between Vineyard
and Kottinger Avenues, East of First St., Now Deisgnated "Held For Further Con-
sideration"
Referral by Cit Coun of a ApueaL Arthur Carroll et al from an Adverse
Derision of the Planning Commission in Denying an Application for an Amendment to
Ord. C -C District
The above matters were ciccussed simultaneously, and Judge Gale, speaking for all
the property owners, related the bac?:g :ourd of these applications indicating that
since all the required public hearings were completed they would appreciate a
decision at this time. He went on to Fey that for the single parcel on the corner
of Vineyard and First the relevent property owner had received a committment from
an Oil Company regarding the development of a gasoline station.
01:13Xt
