<br /> <br /> <br />First Amendment Page 1 <br />FIRST AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE <br />CITY OF PLEASANTON AND THE PLEASANTON UNIFIED SCHOOL DISTRICT <br />RELATED TO LIBRARY CARDS <br /> <br /> <br />This First Amendment to Memorandum of Understanding Related to Library Cards ("First <br />Amendment") is entered into this 22nd day of June 2026, between the City of Pleasanton <br />("City") and the Pleasanton Unified School District (“District”) <br /> <br />Whereas, on July 28, 2023, the City and the District entered into a Memorandum of <br />Understanding related to Library Cards; and <br /> <br />Whereas, Section III of the Memorandum of Understanding set the termination date of <br />the Memorandum of Understanding to be June 30, 2026; and <br /> <br />Whereas, Section III (A) of the Memorandum of Understanding permits an extension of <br />the Memorandum of Understanding for an additional two years upon execution of a written <br />amendment signed by the City and the District; <br /> <br />Whereas, the City and the District wish to enter into this First Amendment to extend the <br />term until June 30, 2028. <br /> <br />NOW, THEREFORE, the parties agree as follows: <br /> <br />1. Section III. Term is amended to read: <br /> <br /> A. This MOU will commence on July 1, 2023 and terminate on June 30, 2028 <br />unless terminated earlier as described below. <br /> <br /> B. This MOU may be terminated by either party by giving 60-days advance <br />notification to the other party in writing. <br />2. This amendment may be executed in multiple counterparts, each of which shall be an <br />original and all of which together shall constitute one agreement. Counterparts may <br />be delivered via facsimile, electronic mail (including pdf or any electronic signature <br />complying with U.S. federal E-Sign Act of 2000 (15 U.S. Code §7001 et seq.), <br />California Uniform Electronic Transactions Act (Cal. Civil Code §1633.1 et seq.), or <br />other applicable law) or other transmission method, and any counterpart so delivered <br />shall be deemed to have been duly and validly delivered and be valid and effective for <br />all purposes. <br /> <br />3.
