City of Pleasanton Article 1. Definitions <br />Franchise Agreement with Pleasanton Garbage Service <br />311 federal, State or local environmental laws currently existing or hereinafter enacted, including, without <br />312 limitation,friable asbestos,polychlorinated biphenyl's("PCBs"), petroleum,natural gas and synthetic fuel <br />313 products, and by-products. <br />314 1.55 Hazardous Waste <br />315 "Hazardous Waste" means all substances defined as Hazardous Waste, acutely Hazardous Waste, or <br />316 extremely Hazardous Waste by the State of California in Health and Safety Code Sections 25117,25110.02, <br />317 and 25115,or in the future amendments to or recodifications of such statutes, or identified and listed as <br />318 Hazardous Waste by the U.S. Environmental Protection Agency, pursuant to the Federal Resource <br />319 Conservation and Recovery Act(42 USC Section 6901,et seq.),all future amendments thereto and all rules <br />320 and regulations promulgated thereunder. <br />321 1.56 Holidays <br />322 "Holidays" means New Year's Day, and Christmas Day for the purposes of planning the Collection <br />323 schedule. <br />324 1.57 Household Hazardous Waste <br />325 "Household Hazardous Waste" means Hazardous Waste generated at Residential Premises within the <br />326 City. <br />327 1.58 Infectious Waste <br />328 "Infectious Waste" means medical or biomedical waste generated at hospitals, public or private medical <br />329 clinics, dental offices, research laboratories, pharmaceutical industries, blood banks, mortuaries, <br />330 veterinary facilities,and other similar establishments that are identified in Health and Safety Code Section <br />331 25117.5. <br />332 1.59 Litter <br />333 "Litter"means any quantity of Solid Waste, Recyclable Materials,or Organic Materials,which is not placed <br />334 in a Container. <br />335 1.60 Liquidated Damages <br />336 "Liquidated Damages" means the amounts owed by Contractor to City for failure to meet specific <br />337 quantifiable standards of performance as described in Section 11.6 and Exhibit E. <br />338 1.61 Multi-Family <br />339 "Multi-Family" means any Residential complex, other than a Single-Family Premises, used for Residential <br />340 purposes,which has centralized Solid Waste and Recyclable Materials Collection service for all Residential <br />341 units in the building and may be billed as one address. <br />City of Pleasanton Page 11 March 8, 2018
