City of Pleasanton Article 1. Definitions <br />Franchise Agreement with Pleasanton Garbage Service <br />464 D. Infectious Waste provided that Infectious Waste,whether treated or untreated, is not Disposed of <br />465 at a Solid Waste facility; and, <br />466 E. Abandoned automobiles. <br />467 Solid Waste includes Salvageable Materials only when such materials are included for Collection in a Solid <br />468 Waste Container. <br />469 1.90 Source Separated <br />470 "Source Separated" means the segregation from Solid Waste, by the Generator,of materials designated <br />471 for separate Collection for some form of materials recovery or special handling. <br />472 1.91 State <br />473 "State" means the State of California. <br />474 1.92 Subcontractor <br />475 "Subcontractor" means a party who has entered into a contract, express or implied, with the Contractor <br />476 for the performance of an act that is necessary for the Contractor's fulfillment of its obligations under this <br />477 Agreement and approved by the City in accordance with Section 12.6 of this Agreement for services such <br />478 as, but not limited to, Collection, Transportation, Processing, Diversion, sales or marketing of Recyclable <br />479 Materials or Organic Materials, staffing, public education, Customer service, and billing, or other service <br />480 whose cost is a substantial portion of the Contractor's total annual cost. Notwithstanding any other <br />481 provision in this Agreement,vendors providing materials,supplies,or professional services to Contractor, <br />482 and Approved Facilities that are not Affiliates of Contractor, shall not be considered Subcontractors for <br />483 any purpose under this Agreement. <br />484 1.93 Term <br />485 "Term" means the duration of this Agreement, as provided for in Article 3. <br />486 1.94 Ton(or Tonnage) <br />487 "Ton(or Tonnage)" means a unit of measure for weight equivalent to two thousand(2,000)pounds where <br />488 each pound contains sixteen (16)ounces. <br />489 1.95 Transfer <br />490 "Transfer" means the act of transferring the materials Collected by Contractor in their route vehicles into <br />491 larger vehicles for Transport to other facilities for the purpose of Processing or Disposing of such materials. <br />City of Pleasanton Page 16 March 8, 2018
