Recommended changes to conditions
1. Small events (currently defined as less than 25 people)—We (4/5) agreed to give Chabad almost unlimited use
of the outdoor patio for small events (until 10 pm). This means Chabad could have unlimited outdoor parties
(adults or kids) including overflow from weddings, social parties, etc. I would not expect my neighbors to have
the right to have unlimited parties or events in their backyard with up to 24 people due to noise
issues. Recommended changes:
a. Redefine small event from less than 25 people to less than 10 people—10 people feels more like a
small meeting or discussion group and less like a party (and therefore less likelihood of loud
noises). There is less risk of large indoor parties such as weddings and kids events overflowing to the
outside if we reduce this to 10. A limit of less than 10 also makes it more manageable for neighbors to
track if issues arise.
2. Large events (currently defined as 25 to 120 people)-- majority agreed to allow 15 outdoor events a year for 25-
120 people. Recommended changes to proposed conditions:
• Redefine large event from 25-120 people to 10-120 people to be consistent with#1 (above)
• Ideally, specify that there will be no more than 1 large event outdoors a month (rationale is to not
bundle up events during warm weather season).
•
3. Other—Property Maintenance—insure building/grounds look acceptable and clean prior to daycare being
allowed (see photos)
• Expand existing condition requiring that the building be painted prior to day care occupancy to also
add the items below
i. Insure building in good state prior to painting on public facing streets
ii. Consider requiring that roof shingles be replaced. Roof is an eyesore and appears to be well
beyond recommended life.
iii. Have landscape maintenance plan in place to clean up litter/weeds and maintain all landscaping
on property—I think staff added this already but please check
Rationale: 1) If we do not ask for property to be in acceptable condition before granting new privileges,
it may never happen. We regularly add this as a condition to project additions and remodels. 2)
Chabad has already had at least 3 code violations in less than a year and we need to be crystal clear
about expectations; 3) Provides teeth to pull back CUP if property not properly maintained.
Thank you for your diligence in insuring that the Valley Trails neighborhood is appropriately protected while also
providing Chabad more flexible conditions that support their organizational goals.
Nancy Allen
2
