My hopes is that this can be built into your staff
report and/or highlighted in your report.
Issue: Most of the examples cited of churches are old very old CUPs which would likely never be permitted as is today
(especially those near neighborhoods). The examples might leave others to think we never restrict daycares or event
locations.
Recommend:
Including more recent examples of CUPs where we did restrict or disallow activities in addition to the one example at
Sunol.
Others that come to mind include:
- Large day cares—we have restricted hours of play, I think we also regularly do this for other public daycares if
near residences
- Events—would be helpful to share how we did not approve event center near Ruby Hills due to noise concerns
and had very tight restrictions on many things that made applicant choose to not do this.
o Are there other locations where we have restrictions on use of outdoors where it is near residences
(e.g., senior center, other?)
o For St. Clare's I do not think they have an outdoor gathering area on National Street (I think it is more
on parking lot side, but wanted to double check).
Thanks for your consideration. Bottom line is I think it would be helpful for Council to have more current examples
that show the trend toward being very deliberate about balancing needs of neighbors with applicant and placing
restrictions.
Nancy
1
