PUBLIC NOTICE
Notice of this application was sent to surrounding property owners and tenants within a
1,000-foot radius of the subject parcel and published in the newspaper. At the time this report
was published, staff has not received any public comments.
ENVIRONMENTAL ASSESSMENT
This proposal is simply consideration for removing the condition of approval prohibiting a
drive-through restaurant use on "Pad B." Any such proposal would be subject to separate
discretionary review by the City, through consideration of a Conditional Use Permit. Since no
development would be considered with this proposal, no environmental document
accompanies this report.
SUMMARY/CONCLUSION
Staff believes the proposal to remove the condition of approval prohibiting a drive-through
restaurant on "Pad B" is inconsistent with the goals, policies, and programs of the General
Plan and the goals and strategies of the CAP. These inconsistencies include greater potential
to create adverse Air Quality impacts due to the drive-through component of the proposed
restaurant, which fails to meet the stated goals of the General Plan and CAP: as well as being
inconsistent with goals to promote a pedestrian-oriented environment to encourage walking
and bicycling. In summary, the drive-through component of the proposed restaurant would
potentially increase vehicular trips and VMT, thereby reducing the number of customers
walking or bicycling to "Pad B" and increasing fuel consumption from those trips and/or from
idling vehicles waiting in the drive-through queue. On this basis, staff recommends the
Planning Commission recommend denial of the proposal to the City Council.
Primary Author Eric Luchini.
