LICENSE <br /> <br /> WHEREAS, The Alameda County Flood Control and Water Conserva-- <br />tlon DJ'strict, acting by and 5hrough the' Board of Su'oervisors o£ <br />ss~id District in behalf of Zone No. 7 thereof~ hereinafter referred <br />to as "Zone 7", owns certain property within the City limits of tho <br />City of Pleasanton hereinafter referred to as "City": s%id property <br />prosentiy being used for the pro%~ision of water throuMh Mocho Well <br />No. l; and <br /> <br /> W~iEREAS: City is desirous of using a portion of said ].aha, for <br />the purpose of installing a water fluoridation facility and housing <br />therefor in order to fluoridate its water in a manner which will not <br /> <br />interfere with the use by Zone '~ <br /> . of said property for the ~ '~',' <br /> <br />purpose of supplying water. <br /> <br /> NOW, THEREFORE, BE IT ,RESOLVED AS FOLLOWS: <br /> <br /> !. .That[ Zone 7 hereby confers upon City a license to use that <br /> certain real property, with access thereto, described <br /> Exhibit "A" attached hereto and incorporated by ?eference <br /> herein for a fluoride treatment facility. Both City and <br /> Zone 7 agree that said license shall be exercised consistent <br /> with the following conditions: <br /> <br /> (a) That the license herein be non-assignable and that <br /> the term thereof' be for ten (10) years from the date <br /> hereof with the option to City to renew said license <br /> for additional 10-year periods upon written applic~ltion <br /> therefor within 90 days of the expiration of any ].0~'ear <br /> term and upon a showing of faithful compliance by City <br /> with the conditions herein. <br /> <br /> (b) City shall comply with all applicable federal, stste <br /> and local laws or ordinances in relyin~ upon the license <br /> <br /> <br />
