5) <br /> <br />6) <br /> <br />7) <br /> <br />8) <br /> <br />Services Not Incliuded: This contract does not include interlibrary loan services <br />beyond the Alameda County Library collection. <br /> <br />Ownership of Loaned Materials/Loss or Dama,qe of Loaned Materials: All materials <br />loaned by the County to the City under the terms of this contract are and will <br />remain the property of the County. The City will be responsible for returning all <br />items loaned to the County by the due date in the same condition as when <br />received. The City will be liable for all materials loaned under the terms of this <br />contract which are lost or damaged. <br /> <br />a. Materials 120 days overdue will be considered lost and will be billed to the City <br /> at a rate of list price. <br /> <br />b. Materials returned damaged will be billed to the City at list price. <br /> <br />c. Charges for lost or damaged materials will be in addition to the contract <br /> amount of $92,927. <br /> <br />The County will submit bills to the City for lost or damaged materials quarterly. <br />These bills shall be separate from the bills for the contract amount and <br />payment will be due in sixty (60) days. <br /> <br />Payments: The City of Pleasanton agrees to pay the County of Alameda $92,927 <br />in four (4) quarte~rly installments as follows: <br /> <br />September 30, 2000 - $23,231.75 <br />December 31,2000 - $23,231.75 <br />March 31, 2001 - $23,231.75 <br /> June 30, 2001 - $23,231.75 <br /> <br />Extension: All terms and conditions of this contract may be extended, by mutual <br />agreement, on a year-to-year basis, provided the City Council desires to continue <br />funding these services for the Pleasanton Library, and provided a separate <br />contract between the City and the County for library automation services is also <br />extended. <br /> <br />Periodic Activity Reports: Reports covering project costs and activities will be <br />provided by the County Librarian to the Pleasanton Library Director who may <br />request such reports at any time. <br /> <br />Option to Terminate or Rene.qotiate Contract: This contract is predicated on the <br />assumption that library funding levels will remain constant. Should any <br />circumstance arise which changes City of Pleasanton or County Library funding <br />levels, either party shall have the right to terminate or renegotiate this agreement <br />by giving at least thirty (30) days written notice. <br /> <br /> <br />
