iii. <br /> <br />The special or emergency maintenance or repair necessitated by traffic collisions, <br />weather conditions, slides, settlement or unusual or unexpected damage to <br />structures, equipment or faciliB'. <br /> <br />4. Legal Relation, and Responsibilities <br /> <br />Nothing in the provisions of this Agreement is intended to affect the legal liability, of either <br />party to the ~Agreement by imposing any standard of care respecting the design, <br />construction, inspection and maintenance of streets, highways, or other public property or <br />facilities, different fi.om the standard of care imposed by taw. <br /> <br />Hold Harmles~ <br /> <br />a. Neither COUNTY, nor any officer or employee thereof, is responsible for any damage <br /> or liability occurring by reason of an.vthing done or omitted to be done by CITY in the <br /> design, eonstmction, and inspection of improvements in conjunction with the <br /> development of Tract 6581, or under or in connection with any work done by CITY <br /> under this Agreement for Maintenance. It is also understood and agreed that pursuant <br /> to Govemment Code, Section 895.4. CITY shall fully indemnify and hold COUNTY <br /> harmless fi.om any damage or liability, occUmng by reason of anything done or omitted <br /> in the design, construction, and inspection of said improvements or anything done or <br /> omitted to be done by CITY under or in connection with any work done by CITY <br /> under this Agreement. <br /> <br />b. Neither CITY, nor any officer or employee thereof, is responsible for any damage or <br /> liability occurring by reason of an.vthing done or omitted to be done by COUNTY <br /> under or in connection with any work done by COUNTY under this Agreement for <br /> Maintenance.
