NOW, THEREFORE, 1T IS AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS:

SECTION I

For and in consideration of the covenants and conditions to be kept and performed

by CITY, a~ provided herein, COUNTY and FAIR BOARD agree to:

1. Install and maintain water meters on the Fairgrounds' w.ell, and to monitor

and maintain daily records of the quantities of water being used for lawn and golf course
irrigation, track watering, and other nonsewage-producing usages, and all other
Fairgrounds usages which ultimately may produee sewage flows, and make such records
available to CITY.

2. Pay annual service charges on a monthly basis for 80,000 gallons per day
(GPD) sewage flow capacity at the 'commercial, all other~ rate as defined ~n page 6-4
and shown on page 6-9 of the Brown and Caldwell report. "User Charge - Industrial Cost
Recovery Study," May 1979, or as may be subsequently modified by City .with the
approval of the State Water Resources* for all water uses exclusive of lawn and g~lf
course irrigation, track watering, and other nonsewage-producing uses. The amount of
80,000 GPD includes an amount which compensates for the expectation that County Fair
activities will, from time to time, generate high peak flows not easily measured and that
these additional expected flows are and shall remain exempt from computation of
monthly average flows. In recognition of the "commercial, all other" rate assigned to the
Fairgrounds, sewage effluent from the Fairgrounds will generally conform to the
characteristics and BOD loading of sewage coming from other mixed commercial
facilities. Industrial-type discharges will not be included in this definition.

3. In reeo~o'nition of the above additional compensations for expected peak flows,
the Fairgrounds' monthly average use, exleusive of peak flows during those parts of June
and July which encompass County Fair activities, shall not rise above ?5,000 GPD. In the
event that the 75,000 gallon limit is exceeded water conservation measures as may be
required to maintain monthly average flowage at or below the 75,000 GPD level shall be
undertaken imm ediately.

* All modifications shall be uniform within the us~ category.

2
