The estimate of construction quantities hereinbefore set forth is approximate <br />only, being given as a basis for the comparison of bids and the City does not <br />expressly or by implication agree that the actual amount of work will <br />correspond therewith, but reserves the right to increase the amount of any <br />class or portion of the work or omit portions of the work as may be deemed <br />necessary or expedient by the Engineer. <br /> <br />All bids will be compared on the basis of the Engineer's Estimate 'of the <br />quantities of the work to be done. <br /> <br />The undersigned has checked carefully all of the above figures and understands <br />that the City shall not be responsible for any errors or omissions on the part <br />of the undersigned in making up this bid. <br /> <br />In case of a discrepancy between words and figures, unit price written in words <br />shall prevail. <br /> <br />If this proposal shall be accepted and the undersigned shall fail to contract <br />as aforesaid and to furnish bonds as provided in said specifications, with <br />sureties satisfactory to the City, within fifteen (15) days after the bidder <br />has received notice from said City that the contract is ready for a signature, <br />the City may, at its option, determine that the bidder has abandoned the <br />contract, and the forfeiture of such security accompanying this proposal shall <br />operate and the same shall be the property of the City. <br /> <br />Enclosed find for $ <br /> , which is not less than ten per cent (10%) of this bid, <br />payable to the City Clerk of the City of Pleasanton, and which is given as a <br />guarantee that the undersigned will enter into the contract if awarded the <br />work. <br /> <br />The undersigned hereby certifies that this bid is genuine, and not sham or <br />collusion, or made in the interest or in behalf of any person not therein <br />named, and that the undersigned has not directly or indirectly induced or <br />solicited any other bidder to put in a sham bid, or any other person, firm or <br />corporation to refrain from bidding, and that the undersigned has not in any <br />manner sought by collusion to secure for himself an advantage over any other <br />bidder. <br /> <br />It is agreed that this bid may not be withdrawn for a period of ninety (90) <br />days from the opening thereof. <br /> <br />The contractor shall commence work of construction under the contract within <br />fifteen (15) days following the execution of the contract by owner.- The <br />contractor shall diligently prosecute the work to completion within 100 working <br />days from the date of the signing of the contract. <br /> <br />The terms and conditions of the final contract When executed shall control and <br />supersede anything herein to the contrary or inconsistent with such contract. <br /> <br />The names of all <br />as follows: <br /> <br />persons interested in the foregoing proposal as principals are <br /> <br />CDS. 1.5 7 <br /> <br /> <br />
