NOV-17-92 TUE 14:24 ZONE 7 ~fiTER AGENCY FflX NO, 5184623914 <br /> <br />11. <br /> <br />Ple&santon's Independent Quota during calendar year <br />199~ shall net be reduced aea result of Pleasanton <br />pumping in excese of ita Independent Quota ~uring <br />calendar year 19~1, as hereinafter more fully <br />described. <br /> <br />Plea~anton shall not be required to pay the Recharge <br />Fee, am required by paragraph B4 of the Contract, for <br />water produotion above its Independent Quota during <br />calendar year 1991~ as hereinafter more fully <br />described. <br /> <br />The provisions of paragraphs 1 and 2 above shall apply <br />only to that portion of Plea~anton's total water use, <br />that is, independent production plus deliveries from <br />Zone 7, whioh between June I and December 31, 1991 does <br />not exceed 8,167 acre-feet. <br /> <br />If Pleasanton's usa mxceeds 8,167 acre-feet between <br />June I and December 31, 1991, th~n the provisions of <br />sai~ Paragraph B3 and B4 will apply to the lesser of <br />the' following: <br /> <br /> (a) Pleasantonts total water use between June 1 <br /> and December 31, 1991 less 8,167 acre-feet; <br /> or <br /> <br /> (b) Pleaeanton's total water pumpage for oalendar <br /> year 1991, less Pleasanton's Independent <br /> Quota of 3,§0O acre-feet. <br /> <br /> <br />
