BE IT FUR'£~R MUTUALLY AGREED that Section XIII, PRIVATE ACCESSES, be <br />added as follows: <br /> <br /> XIII <br /> <br /> PRIVATE ACCESSES. Licensee acknowledges 39 private <br /> <br /> access points along Arroyo del Valle between the Arroyo de <br /> la Laguna and Hopyard Road. The private access points are <br /> to provide access for park and recreation use only, <br /> pursuaut to the conditions of this LICENSE AGREEMENT, and <br /> Licensee shall hold and save Licensor free from all <br /> liability and claims for damages resulting from use of park <br /> and recreation facilities or landscaping pursuant to <br /> Section X hereof. Licensor will permit 39 private gates <br /> pursuant to encroachment permits to be issued by Licensor <br /> to each landowner. Licensee understands that these <br /> encroachment permits are personal to existing landowners <br /> and shall not be transferred. Upon a land sale to new <br /> owners, the owner of the property shall remove t~e gate and <br /> repair the Licensor's fence at the access point between the <br /> lands of Licensor and owner. A list of the addresses with <br /> private access points are attached to this license <br /> agreement as Exhibit "A" and incorporated herein by this <br /> reference. <br /> <br />(6) <br /> <br /> <br />
