A3-7.409M MODIFICATION OF AGREEMENT The Alameda County Flood Control and Water Conservation District, a body corporate and politic {hereinafter referred to as "Licensor',}, and the City of Pleasanton {hereinafter referred to as "Licensee") hereby agree as follows: 1. Recitals and Purposes . Th~s modification is made having considered the following facts and is executed to accomplish the purposes hereinafter recited: A. An agreement by and between Licensor and Licensee was entered into on January 19, 1971, by Resolution No. 9257, providing for the Licensor to confer upon the Licensee the License and privilege to use certain real properties for park and recreation use. Such License is subject to Licensor's continuing and superior rights for flood control and water conservation activities. B. The first of said properties is known as Arroyo del Valle, Zone No. 7, but the extent of this property may be supplemented from time to time by assent of the parties. The description of such additional properties, when agreed upon by Licensor and Licensee, shall be noted by attachment to the agreement. C. Rights-of-way are currently being accepted and minor channel improvements are being implJ~ented by the Licenso~ along Arroyo del Valle between Hopyard Road and Santa Rita Road, as shown on Exhibit A, attached. In exchange for granting the rights-of-way, the Licensee intends to extend the park and trailway system to this area. This requires the modification of the aforesaid agreement to include the new area. 2. Modification A. Licensor and Licensee agree that said agreement is hereby modified to add the area of the Arroyo del Valle between Hopyard Road and Santa Rita Road. as shown in Exhibit A, attached hereto and hereby made a part hereof.
