Resolutl on No. Page 2 easterly thereof, North 76° 42t 46" East, 67.29 feet to an Intersection thereof with the eastern line of the aforesaid parcel of land (71-71836); thence along said eastern line, South 7° 55t Ol" East, 6.53 feet to the aforesaid northern line of said parcel of land described in said deed to the City of Pleasanton (78- 098518); thence along said northern line, South 76° 42' 46" West, 67.29 feet to the point of commencement. Containing 0.010 acre (437 square feet), more or less, and being a portion of the aforesaid parcel of land described in said deed to Alameda County Flood Control and Water Conservation District (71-71836). AND WHEREAS, by Resolution No. 1273, adopted October 21, 1987, the Board of Directors of Zone 7 of the Alameda County Flood Control and Water Conservation District, dtd approve, authorize and request .the gran- ting of a Right of Way to the City of Pleasenton over, upon and across the heretnabove described real property; and WHEREAS, thts Board of Supervisors does and it hereby finds and determines that the public highway use of satd land by the City of Pleasanton will not substantially conflict or interfere with the Alameda County Flood Control and Water Conservatlon District, s use thereof for flood control purposes; NOW, 3~IEREFORE, BE IT RESOLVED, that the request of.the City of Pleasanton be and the same is hereby approved and under the authority of Section 25526.6 of the Government Code of the State of California, the Chatman of this Board of Supervisors be and he is hereby authorized and directed to execute, on behalf of the Alameda County Flood Control and Water Conservation District, a Grant of Right of Way conveying unto the City of Pleasanton, a municipal corporation, a perpetual right of way and easement for public hlghway purposes and appurtenances thereto, over, upon and across the heretnabove described real property; and BE iT FURTHER RESOLVED, that said perpetual right of way and easement is granted upon the follow lng terms and conditions, to wit: 1. There is no charge for the property rights conveyed. Alameda County Flood Control and Water Conservation District is held harmless from damages or claims for damages proximately arising from the public highway use of the hereinabove described real property, Alameda County Flood Control and Water Conservation District is not responsible for the construction, operation, main- tenance, repair and replacement of the public highway and structures and installations appurtenant thereto, together with public utilities, upon the aforesaid real property, AND fence of the acceptance of BE IT FURTHER RESOLVED, that the City of Pleasantonts acc, p- Grant of Right of Way hereby authorized shall constitute the terms and conditions herelnabove set forth.
