from applying new or amended ordinances, rules, regulations <br />and policies which are applicable on a city-wide basis and <br />which do not materially conflict with rights established by <br />this Development Agreement. <br /> <br /> 9. Annual Review. <br /> <br /> a. The City will <br /> <br />Agreement during May or June <br /> <br /> the Agreement. <br /> bo An informal review will be conducted by the <br /> Director of Planning and Community Dew~lopment ("Director") <br /> and need not be documented in any way. Upon not less· than <br /> fourteen (14) days' written notice, O~ers shall provide <br /> such information as may be reasonably requested by the <br /> Director and deemed by him or her to be required in order to <br /> ascertain compliance with this Development Agreement. <br /> c. If the Director believes that the circumstances <br /> require City Council review based upon possible noncompliance, <br /> questions of interpretation, or other reasonable basis, then <br /> the Director may set the matter for review before the City <br /> Council. <br /> d. The Director' shall notify the Owners of the <br /> time and place of the City Council review. The notice shall <br /> include a statement that the City Council review may result <br /> in amendment or termination of the Development A~reement <br /> pursuant to Government Code ~65865.1.
