AGREEMENT <br /> <br />(Deferred Street Improvements) <br /> <br /> THIS AGREEMENT, made and entered into this 13 day <br /> of December , 1977 by andbetween CA~LE~OOD ENTERPRISES, <br /> hereinafter referred to as "Subdivider" and the CITY OF PLEASANTON, <br /> hereinafter referred to as "City." <br /> <br /> RECITALS: <br /> <br /> WHEREAS, Subdivider has submitted an application, MS-77-5, for <br /> a minor subdivision approval to create four lots on 18.6 acres located <br /> at the southeast corner of Foothill Road and Bernal Avenue, in the City <br /> of Pleasanton, County of Alameda, State of California, said property be- <br /> ing more fully described in Exhibit A attached hereto and incorporated <br /> herein by reference; and <br /> <br /> WHEREAS, the Planning Commission of the City of Pleasanton <br /> approved the minor subdivision application by Planning Commission <br /> Resolution No. 1524 attached hereto as Exhibit B and incorporated here- <br /> in; and <br /> <br /> WHEREAS, the Planning Commission's approval was conditioned <br />upon subdivider entering into an agreement providing that subdivider or <br />subdivider's successors participate in the financing of the future im- <br />provements and widening of Foothill Road and the future improvements <br />and widening of Bernal Avenue at such time in the future when under- <br />taken by City or County to the degree required by the present Subdivision <br />Ordinance ~ 2-3.42 and 2-4.14, attached hereto as Exhibit C and incor- <br />porated by reference herein. <br /> <br /> NOW, THEREFORE, for and in consideration of the approval of <br />the Minor Subdivision Map, the parties agree as follows: <br /> <br /> 1. Work. Subdivider agrees to participate in the financing <br />of the engineering and the construction of the street improvements ad- <br />jacent to the subject site to the extent required by Resolution No. 1524, <br /> <br /> <br />
