AGREEMENT FOR INSTALLATION AND ~wLAINTENANCE <br /> <br />OF LANDSCAPING <br /> <br /> THIS AGREEMENT is made this 11 day of October , <br /> <br />197 9 , between Wayne Briggson , <br /> <br />hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, <br />a municipal corporation, hereafter referred to as "City". <br /> <br /> RECITALS <br /> <br /> THIS AGREEMENT IS BASED UPON THE FOLLOWING FACTS: <br /> <br /> (1) Property owner is the owner of real property in the City of <br />Pleasanton described in Exhibit "A", attached to this Agreement and <br />made a part of it by this referen~ce; <br /> <br /> (2) On October 11, , 19 79 , the City granted a Design <br /> <br /> Review Board approval to said property; <br /> <br /> (3) By the terms of the Design Review Board approval, property <br />9wner is required to install and maintain landscaping in accordance <br />with a plan, to be approued by the Planning Department prior to Build- <br />ing Permit approval; <br /> <br /> (4) Both parties recognize that the installation and maintenance <br />of landscaping is an integral part of the property owner's plan for <br />development of the property. <br /> <br />NOW, THEP~EFORE, IT IS AGREED BETWEEN THE PARTIES, as follows: <br />1. ,Purpose. The purpose of this Agreement is to assure (a) <br />installation in accordance with the landscaping plan previously <br />approved by the City and (b) continued maintenance and care of the <br />landscaping. <br /> <br /> <br />
